Terms & Conditions
By accepting a quote, approving artwork, submitting payment, or placing an order with Hiser Customs, the customer agrees to the following Terms & Conditions.
1. Quotes & Pricing
All quotes are valid for thirty (30) days unless otherwise stated. Pricing may change due to supplier price increases, freight costs, material availability, customer-requested modifications, or typographical errors prior to order acceptance.
2. Payment Terms
All orders require a 20% non-refundable deposit before artwork, production scheduling, or materials are ordered. The remaining balance is due before pickup, delivery, or shipment. Accepted payment methods include Cash, Apple Pay, Venmo, and Check unless otherwise agreed in writing. Returned checks are subject to all applicable bank fees and any fees permitted under California law.
3. Deposits & Cancellations
The required deposit is non-refundable. If an order is canceled after artwork has begun, garments have been ordered, materials have been purchased, or production has been scheduled, the deposit will be retained. If costs incurred exceed the deposit amount, the customer agrees to pay Hiser Customs for completed labor, artwork, materials, shipping, and any non-recoverable expenses incurred before cancellation.
4. Final Payment & Collections
Completed orders will not be released until paid in full. Invoices not paid within thirty (30) days after the due date may accrue interest at the lesser of 1.5% per month (18% annually) or the maximum amount permitted by California law. The customer agrees to pay reasonable collection costs, court costs, and attorney's fees if permitted by law and awarded by a court.
5. Artwork Approval
A proof will be provided whenever applicable. Customers are responsible for reviewing and approving: Spelling, Grammar, Phone numbers, Email addresses, Website addresses, Colors, Placement, Garment selection, Sizes, Quantities, Overall layout. Approval authorizes Hiser Customs to begin production exactly as shown. Once artwork has been approved, Hiser Customs is not responsible for customer-approved errors.
6. Production Schedule
Production begins only after: Payment requirements have been satisfied, Artwork has been approved, Required materials are available. Production times are estimates only and are not guaranteed unless specifically agreed to in writing.
7. Rush Orders
Rush production is subject to scheduling availability and may incur additional charges. Estimated completion dates for rush orders are not guaranteed.
8. Custom Orders
Because all products are custom manufactured, all sales are final. No refunds, returns, or exchanges will be accepted after artwork approval or production has begun, except where required by law or when an error is solely the responsibility of Hiser Customs.
9. Customer-Supplied Items
Decoration of customer-supplied garments or products is performed at the customer's risk. Hiser Customs is not responsible for damage caused by hidden manufacturing defects, dye migration, scorching, embroidery hoop marks, shrinkage, print irregularities, adhesive failure, or other conditions beyond our reasonable control. Replacement of customer-supplied items is limited to damage caused solely by proven negligence by Hiser Customs.
10. Product Variations
Due to normal manufacturing and production processes, slight variations in color, print placement, embroidery registration, thread color, garment sizing, and overall appearance are considered acceptable industry standards and shall not be considered defects. Exact color matching cannot be guaranteed.
11. Quantity Variations
Completed quantities may vary by up to five percent (5%) due to standard production processes. Customers will be billed only for the actual quantity produced.
12. Shipping
Risk of loss transfers to the customer once the order has been delivered to the shipping carrier. Hiser Customs is not responsible for carrier delays, lost shipments, or shipping damage.
13. Garment Care
Customers are responsible for following recommended garment care instructions. Hiser Customs is not responsible for fading, cracking, peeling, shrinkage, or damage resulting from improper laundering, ironing, bleaching, dry cleaning, or misuse.
14. Warranty
Hiser Customs warrants only that decoration performed by our company will be free from defects caused solely by our workmanship at the time of delivery. This warranty does not cover manufacturer defects, normal wear, improper care, misuse, or customer-supplied artwork.
15. Intellectual Property
Customers represent they have permission to reproduce all submitted artwork, logos, trademarks, and copyrighted materials. Customers agree to defend, indemnify, and hold harmless Hiser Customs against any claims arising from unauthorized use of intellectual property.
16. Marketing
Unless otherwise requested in writing before production begins, Hiser Customs may photograph completed work for use in portfolios, advertising, social media, websites, and other promotional materials.
17. Refusal of Service
Hiser Customs reserves the right to refuse or cancel any order that: Violates applicable law, Infringes upon another party's intellectual property, Contains unlawful, threatening, discriminatory, defamatory, or obscene material, Creates safety concerns, Is inconsistent with company policies or production capabilities.
18. Force Majeure
Hiser Customs shall not be liable for delays caused by supplier shortages, shipping delays, severe weather, fire, flood, equipment failure, utility outages, labor disputes, government actions, natural disasters, or any event beyond our reasonable control.
19. Storage
Orders should be picked up within thirty (30) days of notification. Reasonable storage fees may be assessed thereafter. Orders remaining unclaimed for ninety (90) days may be considered abandoned to the extent permitted by California law.
20. Limitation of Liability
To the fullest extent permitted by law, Hiser Customs' total liability shall not exceed the amount paid for the affected products or services. Hiser Customs shall not be liable for indirect, incidental, special, consequential, or punitive damages.
21. Governing Law
These Terms & Conditions shall be governed by the laws of the State of California. Any legal action shall be brought in a court of competent jurisdiction in Merced County, California, unless otherwise required by law.
22. Entire Agreement
These Terms & Conditions constitute the entire agreement between Hiser Customs and the customer and supersede all prior verbal or written agreements relating to the order.
23. Severability
If any provision of these Terms & Conditions is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
24. Acceptance
Approval of artwork, acceptance of a quote, payment of an invoice, electronic signature, approval by email, approval by text message, or placement of an order constitutes acceptance of these Terms & Conditions.
