Terms & Conditions
By accepting a quote, approving artwork, submitting payment, or placing an order with Hiser Creative Works (“HCW”), the customer agrees to the following Terms & Conditions.
1. Quotes & Pricing
All quotes are valid for thirty (30) days unless otherwise stated. Pricing may change due to supplier price increases, freight costs, material availability, customer-requested modifications, or typographical errors prior to order acceptance.
2. Payment Terms
All orders require a 20% non-refundable deposit before artwork, production scheduling, or materials are ordered. The remaining balance is due before pickup, delivery, or shipment. Accepted payment methods include Cash, Apple Pay, Venmo, and Check unless otherwise agreed in writing. Returned checks are subject to all applicable bank fees and any fees permitted under California law.
3. Deposits & Cancellations
The required deposit is non-refundable. If an order is canceled after artwork has begun, garments have been ordered, materials have been purchased, or production has been scheduled, the deposit will be retained. If costs incurred exceed the deposit amount, the customer agrees to pay Hiser Creative Works for completed labor, artwork, materials, shipping, and any non-recoverable expenses incurred before cancellation.
4. Final Payment & Collections
Completed orders will not be released until paid in full. Invoices not paid within thirty (30) days after the due date may accrue interest at the lesser of 1.5% per month (18% annually) or the maximum amount permitted by California law. The customer agrees to pay reasonable collection costs, court costs, and attorney’s fees if permitted by law and awarded by a court.
5. Artwork Approval
A proof will be provided whenever applicable. Customers are responsible for reviewing and approving: Spelling, Grammar, Phone numbers, Email addresses, Website addresses, Colors, Placemen,t Garment selection, Sizes, Quantities, Overall layout. Approval authorizes Hiser Creative Works to begin production exactly as shown. Once artwork has been approved, Hiser Creative Works is not responsible for customer-approved errors.
6. Production Schedule
Production begins only after, Payment requirements have been satisfied, Artwork has been approved, Required materials are available, Production times are estimates only and are not guaranteed unless specifically agreed to in writing.
7. Rush Orders
Rush production is subject to scheduling availability and may incur additional charges.
Estimated completion dates for rush orders are not guaranteed.
8. Custom Orders
Because all products are custom manufactured, all sales are final.
No refunds, returns, or exchanges will be accepted after artwork approval or production has begun, except where required by law or when an error is solely the responsibility of Hiser Creative Works.
9. Customer-Supplied Items
Decoration of customer-supplied garments or products is performed at the customer’s risk. Hiser Creative Works is not responsible for damage caused by hidden manufacturing defects, dye migration, scorching, embroidery hoop marks, shrinkage, print irregularities, adhesive failure, or other conditions beyond our reasonable control. Replacement of customer-supplied items is limited to damage caused solely by proven negligence by Hiser Creative Works.
10. Product Variations
Due to normal manufacturing and production processes, slight variations in color, print placement, embroidery registration, thread color, garment sizing, and overall appearance are considered acceptable industry standards and shall not be considered defects. Exact color matching cannot be guaranteed.
11. Quantity Variations
Completed quantities may vary by up to five percent (5%) due to standard production processes. Customers will be billed only for the actual quantity produced.
12. Shipping
Risk of loss transfers to the customer once the order has been delivered to the shipping carrier. Hiser Creative Works is not responsible for carrier delays, lost shipments, or shipping damage.
13. Garment Care
Customers are responsible for following recommended garment care instructions. Hiser Creative Works is not responsible for fading, cracking, peeling, shrinkage, or damage resulting from improper laundering, ironing, bleaching, dry cleaning, or misuse.
14. Warranty
Hiser Creative Works warrants only that decoration performed by our company will be free from defects caused solely by our workmanship at the time of delivery. This warranty does not cover manufacturer defects, normal wear, improper care, misuse, or customer-supplied artwork.
15. Intellectual Property
Customers represent they have permission to reproduce all submitted artwork, logos, trademarks, and copyrighted materials. Customers agree to defend, indemnify, and hold harmless Hiser Creative Works against any claims arising from unauthorized use of intellectual property.
16. Marketing
Unless otherwise requested in writing before production begins, Hiser Creative Works may photograph completed work for use in portfolios, advertising, social media, websites, and other promotional materials.
17. Refusal of Service
Hiser Creative Works reserves the right to refuse or cancel any order that:
Violates applicable law, Infringes upon another party’s intellectual property, Contains unlawful, threatening, discriminatory, defamatory, or obscene material, Creates safety concerns, Is inconsistent with company policies or production capabilities.
18. Force Majeure
Hiser Creative Works shall not be liable for delays caused by supplier shortages, shipping delays, severe weather, fire, flood, equipment failure, utility outages, labor disputes, government actions, natural disasters, or any event beyond our reasonable control.
19. Storage
Orders should be picked up within thirty (30) days of notification. Reasonable storage fees may be assessed thereafter. Orders remaining unclaimed for ninety (90) days may be considered abandoned to the extent permitted by California law.
20. Limitation of Liability
To the fullest extent permitted by law, Hiser Creative Works’ total liability shall not exceed the amount paid for the affected products or services. Hiser Creative Works shall not be liable for indirect, incidental, special, consequential, or punitive damages.
21. Governing Law
These Terms & Conditions shall be governed by the laws of the State of California.
Any legal action shall be brought in a court of competent jurisdiction in Merced County, California, unless otherwise required by law.
22. Entire Agreement
These Terms & Conditions constitute the entire agreement between Hiser Creative Works and the customer and supersede all prior verbal or written agreements relating to the order.
23. Severability
If any provision of these Terms & Conditions is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
24. Acceptance
Approval of artwork, acceptance of a quote, payment of an invoice, electronic signature, approval by email, approval by text message, or placement of an order constitutes acceptance of these Terms & Conditions.
Artwork Policy
All original artwork, logos, graphics, layouts, and designs created by Hiser Creative Works remain the exclusive intellectual property of Hiser Creative Works unless otherwise agreed in writing. Payment for artwork grants the customer a license to use the completed design solely for the project or purpose for which it was created. Ownership of the original concepts, editable source files, production files, and design elements is not transferred. Editable source files, including but not limited to AI, EPS, SVG, PSD, PDF, CDR, INDD, and other native design formats, remain the property of Hiser Creative Works and will not be released as part of any standard design or production order. Any transfer or sale of editable files must be agreed to separately in writing. Upon full payment of the applicable invoice, Hiser Creative Works may provide the customer with a flattened PDF or a high-resolution PNG of the approved final artwork, as appropriate for the completed project. These files are intended for viewing and approved use only and are not editable production files. Customers are responsible for carefully reviewing all proofs before approval. Approval confirms that all spelling, grammar, colors, sizing, placement, quantities, and design elements are accurate. Once artwork has been approved, Hiser Creative Works is not responsible for customer-approved errors. Future revisions, color changes, resizing, layout modifications, recreations, file conversions, or additional artwork requests will be billed at Hiser Creative Works’ current design rates. Artwork submitted by the customer remains the property of its respective owner. By submitting artwork, the customer represents that they have obtained all necessary rights and permissions to reproduce the material and agrees to defend, indemnify, and hold harmless Hiser Creative Works from any claims arising from its use. Low-resolution images, screenshots, or artwork downloaded from social media or the internet may not produce acceptable print quality. Artwork recreation or vectorization may be recommended and billed separately. Customers may not reproduce, modify, recreate, reverse engineer, trace, digitize, vectorize, or commercially exploit original artwork created by Hiser Creative Works without prior written permission. Unless otherwise requested in writing before production begins, Hiser Creative Works reserves the right to display completed artwork and photographs of finished products in its portfolio, website, social media, advertising, and other promotional materials.
Customer Order Agreement

This Order Agreement confirms the customer’s understanding of the order and incorporates the Hiser Creative Works Terms & Conditions and Artwork Policy, which are available at hisercreativeworks.com.
By approving artwork, accepting a quote, signing this agreement, submitting payment, or authorizing production, the customer agrees to the following:
Customer Acknowledgements
☐ I have reviewed and approved all artwork, including spelling, grammar, colors, placement, sizing, quantities, garment selection, and all other design elements.
☐ I understand that custom orders are made specifically for me and that all deposits are non-refundable.
☐ I understand that once artwork has been approved and/or production has begun, my order cannot be canceled for a refund except where required by applicable law or when an error is solely the responsibility of Hiser Creative Works.
☐ I understand that all remaining balances must be paid in full before my order will be released, shipped, delivered, or picked up.
☐ I understand that slight variations in garment color, sizing, print placement, embroidery, thread color, and production are normal industry standards.
☐ I certify that I own or have permission to reproduce any logos, trademarks, copyrighted materials, or artwork that I have submitted.
☐ I understand that Hiser Creative Works retains ownership of all editable artwork, source files, and production files unless otherwise agreed to in writing.
☐ I understand that, upon request and after full payment, I may receive a flattened PDF or high-resolution PNG of my completed artwork. Editable source files are not included.
☐ I acknowledge that customer-supplied garments are decorated at my own risk. ☐ I understand that estimated completion dates are estimates only and may change due to supplier availability, shipping delays, customer approval delays, or circumstances beyond the control of Hiser Creative Works.

Terms of Sale
A 20% non-refundable deposit is required on ALL orders before production begins. All remaining balances are due before pickup, delivery, or shipment.
By approving artwork, accepting this quote, or submitting payment, the customer acknowledges that they have reviewed and agree to the Hiser Creative Works Terms & Conditions and Artwork Policy available at hisercreativeworks.com. Approval of artwork confirms that all spelling, colors, placement, sizing, quantities, and design details are correct. Custom orders are non-refundable once artwork has been approved or production has begun, except where required by law. Hiser Creative Works retains ownership of all editable artwork and production files. Upon request and after full payment, customers may receive a flattened PDF or high-resolution PNG of approved artwork; editable source files are not included. This quotation is subject to the full Hiser Creative Works Terms & Conditions and Artwork Policy, which are incorporated herein by reference.
Sales Tax
Applicable sales tax will be added to all orders unless the customer provides a valid California resale certificate or other documentation establishing tax-exempt status before invoicing.
Customer Delays
Delays in artwork approval, payment, garment selection, or other customer-required information may delay production and estimated completion dates. Hiser Creative Works is not responsible for schedule changes resulting from customer delays.
Shipping Address
Customers are responsible for providing an accurate shipping address. Hiser Creative Works is not responsible for delays, additional shipping charges, or lost shipments resulting from incorrect or incomplete shipping information supplied by the customer.
Digital Mockup Disclaimer
Digital proofs are intended to represent design layout and general color appearance only. Colors displayed on computer monitors, tablets, and mobile devices may vary from actual printed or embroidered products.
Embroidery Disclaimer
Fine details, small lettering, gradients, and certain design elements may require modification to produce acceptable embroidery quality. Hiser Creative Works reserves the right to make minor production adjustments necessary to achieve the best possible embroidered result.
DTF/Screen Print Disclaimer
White ink, specialty inks, metallic inks, puff ink, glitter, and DTF transfers may exhibit slight texture, opacity, or color variations that are considered normal manufacturing characteristics.
Artwork/Design Storage
Hiser Creative Works will make reasonable efforts to retain customer artwork and production files. However, file retention is not guaranteed, and Hiser Creative Works is under no obligation to permanently archive customer files.
